Immigration Psychological Evaluations
A Mental Health Evaluation adds tremendous value to an immigration case. It in fact can be the difference between making or breaking your case. They are used to help immigration courts determine whether an individual can legally remain in the United States. If an attorney recommends that you and/or members of your family should have an assessment, we will gather any relevant information about your case along with any medical or psychiatric history that may be relevant. We will then complete a written report and send it to your attorney. Immigration evaluations can be beneficial for any of the following:
Hardship Evaluations / Waivers
When a U.S. citizen or legal resident may experience significant difficulties if a relative is deported or is refused entry/re-entry into the country, a hardship waiver may be filed. Hardship waivers may be used in these types of cases:
I-601 and I-601A
CR1 or IR1 Visa (Extreme Hardship)
Cancellation of Removal
Fiancee Visa
Same Sex Couples
Fraud or Willful Misrepresentation
Battered Spouse Self-Petitioner
Divorce Proceedings / Custody Disputes
Citizenship Exam Waiver (N-648)
Individuals may qualify for an exemption from the English language and Civics requirements for the U.S. Naturalization process if there is presence of “physical or developmental disability or mental impairment”. This may be from conditions such as dementia, head injury, or intellectual disability.
T-Visa and U-Visa
Foreigners who are victims of serious crimes or human trafficking may be eligible for legal status in the U.S. by applying for a T-Visa and U-Visa.
VAWA / Domestic Violence
Foreigners who are victims of domestic violence by a spouse who is a U.S. citizen or legal resident can be eligible for legal status in the U.S. without having to rely on the abusive spouse to petition on their behalf under the Violence Against Women Act (also known as VAWA).
Political Asylum
A foreigner may apply for political asylum in the U.S. if: they have experienced or fear they will face persecution in their country of origin due to race, nationality, religion, political affiliation, or belonging to a social group.
